Gov. Jeff Landry and Louisiana Economic Development (LED) Secretary Susan Bourgeois announced Tuesday that SpaceX will build what the state calls the largest spaceport in the world on the Vermilion Parish coast near Pecan Island.
The proposed $100B campus will feature five launch complexes of two pads each, propellant farms, a propellant production plant, power generation, vehicle processing, and employee housing, all on part of the 130,000 acres ExxonMobil surrendered to settle a decade of coastal-damage litigation. Later that afternoon on X, Elon Musk promised over a dozen launch towers and more than 30 Starship flights per day.
Construction on Starbase, LA1 is slated to begin in 2027, with the first launch targeted for as soon as 2029. Reaching that milestone hinges on a regulatory clearing operation that ran right up to the week of the announcement.
Washington spent the better part of a year stripping environmental requirements from commercial launch licensing – an effort that culminated in the FAA's July 30 proposal to waive 13 federal statutes, including NEPA and the Clean Water Act's wetlands provisions.
At the state level, Baton Rouge spent 10 weeks rewriting state law around whatever obstacles survived.
The site is raw, undeveloped coastal marsh. Pilings, fill, roads, a rebuilt highway, new power plants and high-voltage lines all have to come first, and SpaceX says it plans to reach initial operations less than three years after breaking ground. That would be the fastest greenfield spaceport buildout in American history, on a shoreline SpaceX itself says is eroding by as much as 23 feet a year. So even with regulatory hurdles out of the way, the marsh would like a word.
Demolition Began in D.C.
Nothing about Tuesday’s news happened fast, and none of it happened by accident.
Trump laid the federal groundwork last summer with E.O. 14335, "Enabling Competition" in the Commercial Space Industry, ordering agencies to gut environmental reviews standing between a company and a launch license. The Supreme Court had already handed him the legal crowbar three months prior in Seven County Infrastructure Coalition v. Eagle County. The ruling scolded lower courts for letting NEPA swell into a project-killing tool — a sentiment the FAA now quotes at length.
Trump doubled down with E.O. 14369 in December, and Transportation Secretary Sean Duffy turned that policy into a proposed rule last month
Louisiana did its part at the state level to roll out the welcome mat for Musk.
A coordinated package of aerospace bills surfaced in Baton Rouge during the final 48 hours before the March 31 filing deadline. Ten weeks later, the package was law: tax rebates, a property-tax exemption, felony trespass protection, a public-records blackout, and a liability shield with an acreage trigger that outed SpaceX as the tenant months ago.
The real estate was the final piece, and the optics are…something.
The state and Vermilion Parish spent more than a decade suing ExxonMobil over canal dredging, pollution, and coastal land loss. Landry announced a settlement in June, and a federal judge finalized the transfer of 130,000 acres to the state this month. Louisiana effectively collected the fragile marsh as damages for wetlands destruction, only to immediately hand it over for the construction of the biggest launch site on Earth.
And then in the week leading up to the long-awaited Abbeville announcement, Trump signed a new national space transportation policy, the FAA published its spaceport-siting RFI, and SwampBase2 was revealed – thanks to a regulatory rollback with a comment window that closes in less than a week.
Thirteen Statutes Down, One Permit Left
Without the FAA's proposed overhaul, SpaceX's timeline crashes into a multi-year wall of federal environmental reviews.
Instead, the new commercial space waiver excises nearly every statute standing between Starship and the Louisiana marsh: NEPA; Endangered Species Act consultations; the Clean Water Act's Section 401 and 404 wetlands provisions; the Coastal Zone Management Act; Clean Air Act conformity; Section 106 of the National Historic Preservation Act; the Marine Mammal Protection Act; Magnuson-Stevens essential fish habitat protections; the Wild and Scenic Rivers Act; the Rivers and Harbors Act; the National Marine Sanctuaries Act; the Transportation Act's parkland provision; and the Noise Control Act of 1972.
The FAA is now asking whether it should expand the purge to roll up eight more: the Ocean Dumping Act, CERCLA, the Safe Drinking Water Act, RCRA, the Toxic Substances Control Act, the Bald and Golden Eagle Protection Act, the Migratory Bird Treaty Act and the National Wildlife Refuge System Administration Act. Three of those are bird protections, and the Louisiana parish is home to more than 100k acres of waterfowl sanctuary.
One major guardrail survives. The FAA waiver covers its own licenses and airspace closures, but it doesn't preempt the Army Corps of Engineers' authority over wetlands. SpaceX still needs a dredge-and-fill permit before the first piling goes in — making that an inevitable flashpoint for the first lawsuit.
Louisiana Legislature Went All In
Washington can only waive federal law, so Louisiana repealed every conceivable barrier it could. Act 874 enacts R.S. 9:2800.31 and bars any lawsuit for nuisance, trespass, inverse condemnation, or strict liability built on noise, sonic boom, overflight, vibration, light, heat, exhaust, smoke, odor, visual intrusion, or temporary access restrictions from aerospace flight activities.

Nearly 60 households in Texas are suing SpaceX in federal court right now, alleging that sonic booms from 11 Starship flights cracked their walls and broke their windows. Their nuisance and trespass claims are what Act 874 outlaws. Louisiana didn't just offer SpaceX a launch site – it built a legal moat around it.
Any claim surviving that shield meets a second one. As of Aug. 1, 2026, HB 1250 gives aerospace companies a special motion to strike, modeled on the anti-SLAPP tool Louisiana wrote to protect defamation defendants from suits meant to silence them. Filing it freezes discovery, so a homeowner suing over noise cannot subpoena launch data or depose engineers, then gives that homeowner 90 days to convince a judge using evidence they couldn't gather. Losing means paying the company's legal bills. Landry's deputy executive counsel told a House committee it was the same machinery with one word changed. Both chambers passed it without a nay. The rest of the package also moved without friction:
Act 190 creates state and local sales-tax rebates for aerospace projects investing at least $1B and creating 200 direct jobs.
Act 102 opens the Industrial Tax Exemption Program to aerospace manufacturers.
Act 188 makes spaceports critical infrastructure and unauthorized entry a felony.
Act 101 removes aerospace records from the public-records law.
Vermilion Parish will not collect conventional property taxes on Starbase, LA. Instead, SpaceX will make a payment in lieu of taxes: $20M up front and at least $25M a year for 25 years, rising annually under an undisclosed escalator. The floor comes to $645M, and the state projects those increases carry it past $820M. Separately, the company is donating $25M to the Community Foundation of Acadiana. Set that against the project's own $100B headline and the parish collects under 1% across a quarter century, in exchange for surrendering the right to sue.
The state has not said whether SpaceX takes title by sale, donation, or long-term lease. Ownership structure determines how much of the land would have been taxable, so whether that $820M is a premium or a discount is TBD.
For scale on how the price of a Starbase has moved, Texas landed SpaceX in 2014 with about $15M, split between $13M from a spaceport trust fund and $2.3M from the Texas Enterprise Fund, for a facility announced at $85M and 300 jobs – growing to more than 4,000 over the last decade. Whether the projected 3,000 jobs for Vermilion Parish prove equally conservative is unknowable, but the state paid roughly 6,700 times more to find out.
Louisiana's state models project a peak workforce of more than 34,000 construction jobs in a parish of just 57,000 residents. Every worker, crane, and concrete truck will funnel down a single coastal highway that has to be rebuilt first.
Federal Funding May Follow
Federal funding for the spaceport seems more plausible after last week. Trump signed the National Space Transportation memorandum on Aug. 20 as NSPM-17, retiring the 2013 policy and targeting more than 1,000 launches and reentries a year by 2030. The order contains no appropriation but allows agencies to partner with companies to build launch facilities together, using leases, private investment, and public-private partnerships for capital improvements on federal property. Cape Canaveral and Vandenberg qualify. Pecan Island does not.
The White House fact sheet issued the same day summarizes that instruction differently, directing agencies to incentivize co-development with private-sector partners but never mentioning the federal-property requirement. It blurs the siting work too. The order gives Transportation 180 days to identify locations for additional launch facilities and gives Interior a separate job finding federal land for one reentry site. The fact sheet fuses them into a single line about Transportation and Interior identifying launch and reentry sites.
The FAA's Aug. 25 spaceport-siting RFI then stands up a National Infrastructure Development Office to expand those partnerships, asking industry what funding constraints exist, what alternative financing structures could work, and how partnerships could finance spaceport development. Under Secretary for Policy Ryan McCormack pitched it as a call to industry and raised the ceiling to 10,000 launches and reentries a year by 2035.
Whatever spaceport financing structure emerges, it will not run through NASA. The agency's Office of Inspector General confirmed in June that the Antideficiency Act bars NASA from spending appropriated dollars on facilities that primarily benefit a commercial partner. By definition, a spaceport SpaceX owns and operates in Vermilion Parish is exactly that. The Space Ready 2.0 Act, introduced this month, would loosen the rules in the opposite direction, letting companies pay to modernize infrastructure at NASA centers, like Kennedy. Again, StarBayou3 would not qualify.
The Pentagon labors under no such handicap. Congress gave the department authority in the FY13 defense authorization to accept commercial funds for launch infrastructure at military ranges, the transaction the Antideficiency Act denies NASA. Congress then appropriated $1.3B for construction across FY24 through FY28, the fund Vandenberg is now tapping for Space Launch Complex 14. Neither authority extends beyond government-owned property.
Only the Office of Strategic Capital reaches private land. OSC makes direct loans of $10M to $150M to companies building or expanding commercial facilities, and space launch is one of the 31 technology categories it covers. Congress funded the credit account with $97.8M for FY26, enough to subsidize $4.4B in loans and guarantees, and the Pentagon has requested more than $20B for FY27 against a backlog of 200 applications seeking $8.9B.
The likeliest federal lever is probably neither a partnership nor a loan.
It's a designation.
The FY26 defense authorization ordered the Air Force to study whether the country needs another heavy-lift launch site, and Air Force Secretary Troy Meink told the House Armed Services Committee in May that the answer is probably yes. The report remains unreleased, so his testimony is the only public account. But it’s hard to see how it lands otherwise: The Cape and Vandenberg handled 175 launches in 2025 and project as many as 700 by 2036 – a cadence neither range can absorb. The Space Force is also drafting its Spaceport 2036 strategy to lay out its infrastructure needs over the next decade.
A designation would move Pecan Island onto a different funding track. Name Starbase, LA as the third heavy-lift site the Pentagon says the country needs, and it becomes national security infrastructure serving a stated military requirement – a status that justifies range instrumentation, tracking and communications, road and utility work, and the same cost-sharing partnerships the FAA's RFI is asking industry to design.
Until the federal piece is sorted, Louisiana opens the spigot. LED says the Department of Transportation and Development is evaluating Highway 82 improvements and expects the state and SpaceX to share those costs.
Long Road From Capex to Cadence
SpaceX’s estimated $100B investment equals about 5.4 quarters of SPCX’s current total capex, spread across a build that starts in late 2027. Annualized over a decade, that runs about $10B a year.
SpaceX's own Texas construction record provides a timeline for when the site might be operational, adjusted for the usual. At Boca Chica, the FAA published the notice of the draft environmental impact statement on April 19, 2013, held its public hearing that May, and finished the EIS in 2014. Texas and SpaceX struck their deal that August, and construction started the following month. The first flight test was in July 2019, nearly five years after groundbreaking, when a single-engine prototype called Starhopper flew a few dozen meters before landing. Starship’s inaugural test flight wasn't until April 2023 – 8.5 years from groundbreaking and a decade after the first federal filing. Granted, SpaceX spent most of that time engineering Starship, but it wasn't answering to public markets then either.
In Florida, rebuilding on developed federal range land still takes about two years of review plus another two or so of construction. SPCX holders should read Louisiana as a capital commitment whose first revenue-bearing launch realistically falls in the 2030s.
Geography Does Not Negotiate
While it takes a massive expenditure of political capital to bend a federal statute, it's impossible to lobby a coastline. Even with the legal guardrails stripped down to the studs, Starship will dogleg for a living out of Louisiana. Pecan Island sits near 29.6 degrees north on a coast facing a closed basin, so a due-east launch runs into Florida and a due-south shot finds the Yucatán Peninsula roughly 600 nautical miles downrange.
The workable corridors thread the Yucatán Channel between Mexico and Cuba or the Florida Straits, the same geometry Boca Chica has managed since 2023. A due-east launch bottoms out near the site's own latitude, so reaching the 53-degree shell that carries the Starlink workhorse fleet costs either a dogleg penalty or an on-orbit plane change. Sun-synchronous and near-polar orbits overfly Mexico outright. Louisiana at least buys margin Boca Chica never had, since 600 miles of Gulf gets Starship high and fast before it crosses the coast. But margin is not total immunity. Overflight still requires Mexico's cooperation regardless of altitude, and an ascent failure still puts debris on a ground track that ends in Mexican territory.
Mexico has already made that a problem once. Its government threatened claims over Starship debris washing up in Tamaulipas in the summer of 2025, then backed off last month in favor of a coordination protocol running through the two foreign ministries, with advance launch notice, mariner warnings and debris tracking. But that protocol is a handshake, not a treaty, and Mexico can walk away from it whenever a launch goes sideways. The FAA's February 2026 tiered environmental assessment for expanded Starship trajectories already requires airspace closures over portions of Mexico.
Methane, Megawatts and Miles of Marsh
Vermilion Parish sits next to Cameron Parish, home to the LNG export terminals that anchor Louisiana's gas industry, and Starship’s Raptor engines burn methane. LED concedes the project needs new power plants and high-voltage lines, and SpaceX has committed to absorb those costs. SpaceX is reportedly hiring a natural-gas trader to build and lead a trading desk.
The parcel solves two more problems beyond fuel and power. Starship is too large to move by road or rail, so the hardware travels by water, and the Port of Iberia puts a fabrication and barge corridor within reach.
Then there’s the acoustic buffer – an asset money essentially cannot buy. A Raptor test stand needs miles of complete isolation between the flame trench and the nearest human ear, so 130,000 acres of open marsh delivers that and then some. It’s the exact margin McGregor lost once suburban encroachment caught up to its test stands and the noise complaints started rolling in. Isolation plus deep-water barge access makes Pecan Island a premier engine manufacturing and testing complex that can spool up years before a single launch mount goes vertical. Plus, it’s entirely insulated from flight corridor chokepoints and an FAA licensing purgatory.
The Avian Veto
The spaceport faces one more opponent capable of fowling the entire timeline.
The town of Gueydan, population 1,165, has held a state trademark on the title “Duck Capital of America” since 1977, when a local women's club registered it with the Secretary of State. The proposed spaceport sits inside one of the continent's principal waterfowl wintering grounds, where Ducks Unlimited tracks half the Mississippi Flyway's wintering ducks through coastal Louisiana's marshes.
The footprint borders the state's 72,000-acre White Lake Wetlands Conservation Area, ranked among North America's most critical winter waterfowl habitats and home to Louisiana's whooping cranes — a species for which the Landry administration recently commissioned a long-term master plan. Immediately east sits Audubon’s oldest holding, the 26,000-acre Rainey preserve, established in 1924. That puts about 100,000 acres of sanctuary in the parish before the first piling ever touches the mud.
To understand the political gravity of that ecosystem, look a bit further north. In late July, the U.S. Fish and Wildlife Service opened a 14-day comment window on loosening drain-tile setbacks around wetland easements in the Prairie Pothole Region across Montana, the Dakotas, Minnesota, and Iowa. Ducks Unlimited instantly launched a “Don't Drain the Duck Factory” campaign, joining Delta Waterfowl, California Waterfowl, and South Carolina Waterfowl in a direct escalation to Interior Secretary Doug Burgum.
The docket was flooded with 219,000 comments, forcing the agency to abruptly pause the rollout on Aug. 14. North Dakota Sen. Kevin Cramer responded by freezing every remaining Trump nominee in protest and calling the President directly.
Different wetlands, different rule, different agency. But it is the exact same migration route, the same hyper-mobilized red-state constituency, and the same risk to the construction schedule. Pecan Island residents have already organized under the banner StopSpaceX, and Landry’s team is clearly prepared for the opposition. They opened Tuesday’s spaceport press conference talking about coastal restoration for a reason.
Washington and Baton Rouge may have been able to vaporize a century of environmental statutes to roll out a regulatory red carpet for SpaceX, but the Duck Dynasty could still bird-strike the schedule in the end.
